NIL: What It Actually Is, What It Is Not, and What the Rules Are in 2026

NIL — Name, Image, and Likeness — refers to an athlete's right to profit from their own identity. Since the NCAA's NIL policy went into effect in 2021, college athletes can legally earn money from endorsements, appearances, social media, camps, and more.

What NIL is:

The right to be paid for endorsing a product or service
The right to earn money from your own social media content
The right to be paid for appearances, autographs, and camps
The right to work with an agent or collective

What NIL is not:

A salary from your school or the NCAA
A guarantee of any specific amount of money
Protection from bad deals, predatory agents, or financial mismanagement
A replacement for academic eligibility or athletic performance

The rules vary by state, by school, and by sport. Before signing any NIL deal, every athlete should: (1) notify their athletic compliance office, (2) have someone review the contract, and (3) understand the tax implications. NIL income is taxable income.
