1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AthleteIQ platform and all related services operated by Pathway Sports Group, LLC ("Pathway Sports Group," "we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy.

If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf. If you are a parent or guardian registering a child under 13, you are accepting these Terms on behalf of your child.

2. Description of Service

AthleteIQ is a character development and athlete accountability platform that tracks six core traits — Coachability, Discipline, Leadership, Mental Toughness & Resilience, Accountability, and Being a Good Teammate — through daily check-ins, coach evaluations, peer assessments, and behavioral data. The Platform serves athletes (ages 8 and up), coaches, parents, schools, and college recruiters.

3. Account Registration

• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One person may not maintain multiple accounts. Accounts are non-transferable.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Roles and Permissions

The Platform supports multiple user roles with distinct permissions:

• Athletes: May submit daily check-ins, view their own scores, and participate in team features enabled by their coach.
• Coaches: May view team rosters, submit evaluations, enable peer evaluations, post motivational content, and manage team settings.
• Parents/Guardians: May view their linked athlete's progress data with consent.
• College Coaches / Scouts: May access the Scout Portal to view character profiles of athletes who have opted into recruiting visibility.
• Administrators: Have elevated access to manage institutional accounts and data.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent check-in or evaluation data
• Harass, bully, or intimidate other users through any Platform feature
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or attempt to extract the Platform's source code
• Use automated scripts, bots, or crawlers to access the Platform
• Upload or transmit malicious code, viruses, or harmful content
• Misrepresent your identity, role, or affiliation

6. AthleteIQ Score and Evaluations

The AthleteIQ Score is a proprietary composite metric calculated from self-assessments, coach evaluations, and behavioral data. It is intended as a developmental tool and coaching aid, not as a definitive measure of an athlete's character or worth.

Pathway Sports Group makes no warranty that the AthleteIQ Score will result in recruiting interest, scholarship offers, or any specific outcome. Coaches and evaluators are responsible for the accuracy and fairness of their evaluations.

7. Scout Portal and Recruiting

Athlete profiles in the Scout Portal are only visible to verified college coaches and recruiters. Athletes and their parents/guardians control recruiting visibility settings. Pathway Sports Group does not guarantee any recruiting outcomes and is not responsible for decisions made by college coaches based on Platform data.

Athletes under 13 are never visible in the Scout Portal regardless of settings.

8. Subscription and Payments

Certain features of the Platform require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

We reserve the right to change pricing with 30 days' notice to current subscribers. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

9. Intellectual Property

AthleteIQ™, Pathway Sports Group™, and all associated names, logos, taglines, slogans, and content — including but not limited to “Stats get you noticed. Character gets you recruited.”™ — are proprietary to Pathway Sports Group, LLC and are protected by United States and international trademark, copyright, and trade secret laws.

The AthleteIQ Score algorithm, character evaluation methodology, trait weighting system, and all related scoring and analytics processes are trade secrets and proprietary intellectual property of Pathway Sports Group. Unauthorized reproduction, reverse engineering, disclosure, or use of these methodologies — in whole or in part — is strictly prohibited and may result in civil and criminal liability.

The Platform, including all content, features, functionality, design, text, graphics, user interface, and underlying software, is owned exclusively by Pathway Sports Group and protected by applicable intellectual property laws. No license to use any Pathway Sports Group intellectual property is granted except as expressly set forth in these Terms.

You retain ownership of content you submit to the Platform (such as check-in responses and evaluations), but you grant Pathway Sports Group a non-exclusive, royalty-free, worldwide license to use, process, and display such content solely to operate and improve the Platform.

Any unauthorized use of Pathway Sports Group's trademarks, trade secrets, or proprietary content — including copying, reproducing, distributing, or creating derivative works — without express written permission is a violation of these Terms and applicable law.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PATHWAY SPORTS GROUP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHWAY SPORTS GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which Pathway Sports Group is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.
